  There are hundreds of background check  services advertised on-line, however the vast majority of on-line background check services simply do not deliver the information they promise. The information sold is frequently outdated, incorrect, or nothing more than data from local phone directories, despite widely advertised claims. We are not an information broker. Our background screenings are done by licensed private investigators, not a database company.

  When we conduct a background check we start by verifying that the subject’s personal identifying information that was provided  to us initially, such as name, address, date of birth or social security number, is correct. This information  is used during research to verify that the records we are looking at belong to the person in question and not someone  who shares the same name. We then research, verify and analyze data collected from a wide range of sources in order  to provide you with a complete accurate investigative report that you can rely on.

 

Pre-Employment Background Screenings

  Businesses lose millions in income annually because Worker’s Compensation fraud increases their costs for employee health coverage and business insurance. A pre-employment screening is one of the guidelines that  businesses can follow, as suggested  by the Coalition Against Insurance Fraud (CAIF), in order to decrease losses from Workers Compensation fraud, although no fraud-prevention mechanisms have been proven foolproof (North  American Training Group).

  Another reason why is it so important for businesses to conduct pre-employment screenings is that they can reduce  their liability for negligent hiring lawsuits by implementing background screenings of their employees and contractors in  accordance with Florida Statute 768.096 - Employer Presumption Against Negligent  Hiring.


A pre-employment  release form from the potential employee is required in order to complete this type of investigation.

 

Florida Statute 768.096 Employer presumption against negligent hiring.—

 

 (1) In a civil action for the death of, or injury or damage to, a third person caused by the intentional tort of an employee,  such employee’s employer is presumed not to have been negligent in hiring such employee if, before hiring the  employee, the employer conducted a background investigation of the prospective employee and the investigation did not  reveal any information that reasonably demonstrated the unsuitability of the prospective employee for the particular work  to be performed or for the employment in general. A background investigation under this section must include:

 (a) Obtaining a criminal background investigation on the prospective employee under subsection (2);

  (b) Making a reasonable effort to contact references and former employers of the prospective employee concerning the  suitability of the prospective employee for employment;

 (c) Requiring the prospective employee to complete a job application form that includes questions concerning whether  he or she has ever been convicted of a crime, including details concerning the type of crime, the date of conviction and  the penalty imposed, and whether the prospective employee has ever been a defendant in a civil action for intentional  tort, including the nature of the intentional tort and the disposition of the action;

 (d) Obtaining, with written authorization from the prospective employee, a check of the driver’s license record of the  prospective employee if such a check is relevant to the work the employee will be performing and if the record can  reasonably be obtained; or

  (e) Interviewing the prospective employee.

 

(2) To satisfy the criminal-background-investigation requirement of this section, an employer must request and obtain  from the Department of Law Enforcement a check of the information as reported and reflected in the Florida Crime  Information Center system as of the date of the request.

 

(3) The election by an employer not to conduct the investigation specified in subsection (1) does not raise any  presumption that the employer failed to use reasonable care in hiring an employee.

National Criminal Background Screenings

 

Despite the claims that you see online from companies who state that they have access to a complete and     accurate “National Database of Criminal Record Information” the reality is that NO SUCH DATABASE EXISTS. Beware of any  company that claims it does. Each state and each court has it’s own unique way of recording and maintaining criminal information. For proper due diligence when performing a criminal record search, the search should be conducted not only at a state level but a county level.as well.
